Duke Energy sues over Cincinnati streetcar

The city of Cincinnati and Duke Energy are headed to court over the streetcar.

Duke Energy Corp. filed a lawsuit late last week over its long-standing dispute with the city of Cincinnati and its streetcar project.

Duke and the city have been at odds over the cost and process of moving utility lines in the way of the proposed streetcar project. As the Courier reported in early February, the two sides agreed to allow the project to move ahead and work out their dispute in court.

WLWT.com reports that, in its lawsuit, Duke claims the city has created a public utility with the streetcar line and is violating the law by imposing costs for one utility by another. Duke says the city can't force it to move its utility lines and must pay for the cost of the relocation.

This news comes just days after the city received bids for construction work on the project that were significantly over budget.

The opening of the streetcar has been pushed back to 2015.
